1. What if creditors keep contacting me after the filing of my bankruptcy?

    If you filed your bankruptcy with an attorney, you should contact them. If you didn’t have an attorney, you should NOT contact the Trustee. He is not an Attorney,  he can not help you.

  2. What if I need copies of my paperwork?

    You may obtain copies of your paperwork from the US Bankruptcy Court at the following address:

  3. When will my case close?

    Your case will not close until the Trustee receives a copy of the tax returns for the year of your filing and the one after.

  4. When will I receive my discharge?

    You will receive your discharge 60 days from the conclusion of your scheduled meeting of creditors with the Trustee. It will come directly from the US Bankruptcy Court, and NOT from the Trustee.

  5. Does my Discharge mean that my case is closed?

    NO, your case is not closed until all issues are addressed and resolved with the Trustee (including tax returns, and refunds).

  6. Who do I need to notify of any address change?

    You need to notify the US Bankruptcy Court of any address change, as long as your case is still open. You may use this form to do so.

  7. Do I need to endorse the tax refund checks?

    No, you don’t have to.

  8. Who do I make any checks, money orders or payments payable to?

    Lawrence J. Warfield, Trustee.  Please indicated your case number on all payments.

  9. How long do I have to wait to apply for a loan?

    That is not something to ask the Trustee.  If you have an attorney, you should direct those questions to him.

  10. What if the IRS or any other taxing agency kept the tax refunds for another debt?

    If that is the case, you need to provide the Trustee with a copy of the letter from the taxing agency indicating the reason for the offset.

  11. What is a reaffirmation agreement?

    A reaffirmation is an agreement with a creditor regarding a debt. Most reaffirmations are for secured property (i.e. house, vehicle).  It indicates what your intentions are regarding that property, and that you are going to re-affirm the debt (continue to pay).

  12. Why would the Trustee’s office not return my call?

    Please be aware that the Trustee handles many cases. Be patient, and the office will get back to you with in 24 hours. His hours are 8-5 Monday thru Friday.
